Here we go again.  Another board member of a youth sports association stealing money.  This time a board president, Leo Carlos, took $70,000 over 4 years.  Once again, no one had access to the association’s records.  Board members trusted Leo and he took advantage of that trust.  Some boards require dual signatures on checks, but what if both signers are in cahoots?  W’eve seen a lot of situations where boards require dual signatures and it becomes inconvenient and then not required in all cases.   The only way effectively to deter and root out fraud in association boards is to …

$50k Stolen by Youth Football Board President

The board president of a youth football association stole $50k using it for car repairs, vehicle registration, hotel rooms at two local resorts and braces for himself and his family.  Like many youth sports associations around the country, this board had no organizational framework.  The president had all the association records, bank and financial information and none of the board members had access. This gave Steven Leslie Marshall Jr. freedom to use the association as his piggy bank, taking whatever he wanted, whenever he wanted.  These associations require organizational framework around them so that board members can log in and see all …

PTA President-Treasurer Steals $20k – No Organizational Framework Again

Another $20k theft by a PTA board member reported yesterday. The trusted president/treasurer “was not cooperative in providing bank statements and information to incoming officers and would become defensive when questioned about accounts.” PTAs/PTOs need organizational framework where board members have access 24/7 to records and communications so that they can watch each other like any good business. Kristin Lynn Mandrick had insisted on taking over the role of treasurer of Florida’s South Fayette Parent-Teacher Association after previously serving as president for two years. Other members began experiencing issues with Mandrick not performing assigned tasks. During the transition to new officers for …

PTO Treasurer Steals over $57,000 – No Framework around the Organization

From November 2016 to May 2018, the treasurer of a Parent Teacher Organization stole over $57,000 from the organization.  Tami Herrold made 162 fraudulent charges or withdrawals during the two years and no one was watching.  The money is gone now. The problem is that board members weren’t watching because they had no way of easily doing so.  Tami had all the financial records and there was no organizational framework in place where board members could access records whenever and wherever they wanted to keep an eye on the money.  This allowed Tami steal. Office of the Board is the …

The January 1, 2019 Florida Web Portal Deadline is Fast Approaching

Florida community associations that have to comply with the new web portal requirements are running out of time.  The deadline is January 1st and it was already extended one time so we don’t expect it to be extended again. If your Florida association has  150 or more units assume you have to comply and have a web portal in place so that owners can access a laundry list of official records.   All associations have official record keeping and inspection by owner requirements of many more records, but as for the laundry list, those documents must be digital and available …

PTAs/PTOs require Framework around their Organizations to Prevent Fraud

Parent Teacher Associations or Organizations often rely upon the resources that are available to them by their school districts or some other free technology to run their organizations. The trouble with this is that it doesn’t prevent fraud.  We have seen “trusted” board member thefts of PTA/PTO money throughout the country.   Here are just a few PTA/PTO board member thefts: $50,000 Embezzled by Pennsylvania PTO Treasurer  $24,000 Stolen by Connecticut PTA Treasurer $14,700 Stolen by Texas PTA Vice-President $9,000 Taken by Florida PTA Board Member $2,000 Embezzled by Ohio PTA Board President $2,000 Stolen by Tennessee PTO President Without …

Board Member Kickbacks at Issue in Florida HOA

The Winding Hollow Homeowners Association eventually figured out that board member Ken Spalthoff was receiving kickbacks from a landscaping company.  They are suing him now in the Florida courts.  A police investigation determined that there was no criminal violation by the Winter Springs mayoral candidate, but the HOA is not letting him off the hook.  Whether Spalthoff acted inappropriately or not will bear itself out in a public forum.  The HOA should be careful about defaming the political candidate, but Spalthoff’s days in public service may be over if determined true.  The answer will be in the HOA’s records. Office of …

Treasurers have to be Watched

We’ve seen it time and time again. Association treasurer steals from organization. It happened again in Ohio where a condo treasurer made 48 withdrawals from the association’s account into his personal account from 2016 to 2017.  It was not until this year that the board members realized what was going on. Here’s more. Board members like that one were not looking at the bank statements.  Why?  They didn’t have access to them.  Every board member should be keeping an eye on their association’s financials and its treasurer.  They have a fiduciary duty to the organization and its members to be …
